The Regulations provide that a worker or employee may be dismissed if he or she has engaged in certain acts set forth herein and has shown no sign of repentance following education or administrative sanction s. When an enterprise dismisses a worker or employee, the trade union of the enterprise shall be consulted s. A dismissed worker may appeal to the local labour dispute arbitration committee and then to the local people's court s.

A certificate of dismissal enables the worker or employee to go to the labour office to register his or her unemployment s. Provisional Regulations on the recruitment of workers in state-run enterprises, issued by the State Council. These Regulations provide that recruitment of workers by enterprises are to be done in public and open to all.

Vacancy notices and lists of candidates having passed the required examination are to be published s. The basic conditions for recruitment are set forth: 16 years of age, in good health, educational level of junior middle school or above, good character, and passing a comprehensive examination political integrity, knowledge, etc. Women workers shall be recruited "for jobs suitable for women" s. The Regulations also describe the administrative arrangements for handling recruitment activities Chap.

The system of contracts of employment is to apply to recruitment s. Provisional Regulations on unemployment insurance for workers and employees in state-run enterprises, issued by the State Council.

Under these Regulations, an Unemployment Insurance Fund is set up, in part to ensure that the basic daily needs of workers and employees in state-run enterprises are met. The Regulations apply to workers and employees of bankrupt enterprises, those laid off or made redundant by an enterprise on the verge of bankruptcy or undergoing reorganisation during the period fixed by law, those whose contracts of employment have been terminated or cancelled by the enterprise and those who have been dismissed s.

The Regulations provide for contributions to the Fund by workers and enterprises, and set forth the purposes for which payments may be made from the Fund e. Employment services attached to the local labour administrative authorities are in charge of the Fund as well as of providing employment guidance and job referrals for the unemployed s. Since , mobility of technological staff in state owned economic sectors has been allowed in limited circumstances.

This Circular reassures and further promotes the mobility of this group of personnel in order to solve the problems of 'idleness, wastage and improper deployment' of technological staff in planning economy. Wages in such enterprises are to be determined by the board of directors, but shall be no less than per cent of the average wages in state-owned enterprises under similar conditions in the same trade and in the same locality.

Wages may be adjusted according to the economic performance of the enterprise. The enterprise shall contribute to the retirement and unemployment insurance funds and shall pay housing subsidies. Insurance and welfare available to the workers are to be determined in line with relevant provisions issued by the Government. Employment Amendment Ordinance The Ordinance supplements the Employment Ordinance with a new Part VB and two schedules, providing for long service payments on separation.

The amount of the payment depends on the worker's age and length of service. For example, an employee over 40 years of age who has been employed on a continuous basis for five to ten years will be entitled to compensation equivalent to two-thirds of his or her last monthly wage; such compensation will be payable only to persons who are not otherwise eligible for severance pay.
